These terms are short and written in plain English. Please read them; by using the website you agree to them.
1. Who we are
Test Junkie™ is an open-source Python test framework. This website, www.test-junkie.com (the "site"), is run by Artur Spirin, an individual based in New Mexico, USA, who maintains the Test Junkie project. In these terms, "we", "us" and "our" mean the operator of the site; "you" means anyone who visits or uses it.
The site has no user accounts and does not sell anything.
2. Accepting these terms
By using the site you agree to these terms and to our Privacy Policy, which explains what information the site collects (for example, through Google Analytics) and how it is used. If you don't agree, please don't use the site.
If you use the site on behalf of an employer or another organization, you confirm that you are allowed to accept these terms for it.
3. The software has its own license
Test Junkie, Test Junkie HQ and the other software of the project are not governed by these terms. Each is governed only by the license file in its own repository (Test Junkie is released under the MIT license). That applies however you get the software: from GitHub, from PyPI, or by following a link on this site.
If anything in these terms conflicts with a software license, the license wins for that software.
4. Using the content on this site
The site includes documentation, tutorials, guides, a demo report, images and other material (the "content").
- Code samples. Code examples and snippets shown in the documentation and tutorials are licensed to you under the MIT license. You may copy them into your own projects, commercial or not.
- Everything else. The text, images, logos, graphics and design of the site are © Artur Spirin and are not licensed for reuse except as described here. You may read, print and save pages for your own use, link to any page, and quote short passages with a link back to the source. Please ask before republishing larger parts of the site.
- The demo report uses sample data made up to show what a Test Junkie report looks like. It is an illustration, not a benchmark or a measurement of real projects.
We reserve all rights not expressly granted in these terms.
5. Acceptable use
Please use the site in a lawful and considerate way. You agree not to:
- break any law, or anyone else's rights, while using the site;
- try to gain unauthorized access to the site, its servers or any related system, or probe, scan or test their security without our written permission;
- interfere with the site's operation, for example by overloading it, sending malicious code, or running scrapers or crawlers at a rate that degrades it for others (normal search-engine indexing is welcome);
- pretend to be us, or suggest we endorse you or your product when we don't;
- copy the site, or present its content as your own, beyond what section 4 allows.
If you think you've found a security problem with the site or the software, please report it privately (see Contact) rather than publishing it first.
6. Links and third-party services
The site links to services run by other companies, including GitHub, PyPI, Patreon, PayPal and social media platforms, and it uses Google Analytics and Google Search Console. We don't control those services. Your use of them is governed by their own terms and privacy policies, and we are not responsible for their content, availability or practices. A link doesn't mean we endorse everything on the other side of it.
7. Donations
The site links to Patreon and PayPal where you can choose to support the project.
- Donations are entirely voluntary. You receive no goods, services, support, priority or other benefit in return, and the software stays free whether or not you donate.
- Test Junkie is not a charity. Donations are not tax-deductible.
- Payments are processed by PayPal or Patreon under their own terms. We never see or store your card details.
- Donations are generally not refundable. If you donated by mistake, contact us and we'll do what we reasonably can.
8. Trademarks
"Test Junkie", "Test Junkie HQ" and the Test Junkie logo are trademarks of the operator of the site (shown with ™; they are not registered). The open-source licenses let you use, copy, modify and distribute the software, but they do not give you any right to use these names or logos.
You may use the names to refer to the project truthfully, for example "built with Test Junkie", "a plugin for Test Junkie" or "a fork of Test Junkie". You may not use the names or logos as the name or branding of your own product, fork, service or domain, or in a way that suggests we made, endorse or support something we didn't.
All other product names and trademarks mentioned on the site belong to their owners and are used only to identify their products.
9. Our social media accounts
The project's official accounts are the Facebook Page "Test Junkie", Instagram @_testjunkie, the GitHub repository ArturSpirin/test_junkie, and a LinkedIn page for Test Junkie. Our posts there are covered by sections 4, 8, 10 and 11 of these terms as well as by each platform's own rules. Comments and messages from other people belong to them and reflect their views, not ours.
Some of our posts and images are drafted with the help of AI tools. A person reviews everything before it is published.
10. Disclaimer of warranties
We work hard to keep the site accurate and useful, but it is provided free, "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or availability.
In particular, the documentation, tutorials and examples may contain mistakes or describe a different version of the software than the one you use. Check them against your own setup, and test changes before relying on them in anything that matters. Nothing on the site is professional advice.
11. Limitation of liability
To the fullest extent the law allows:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, business or goodwill, arising from or related to the site, its content, or these terms, even if we were told such damage was possible; and
- our total liability for all claims arising from or related to the site, its content, or these terms is limited to US$100.
These limits apply whatever the legal theory (contract, tort including negligence, or otherwise). Some places don't allow certain warranties to be excluded or liability to be limited; in those places, these sections apply only as far as the law there permits, and nothing in these terms limits liability that cannot legally be limited, such as liability for fraud or for gross negligence or willful misconduct where the law forbids limiting it.
12. Indemnity
If you misuse the site, or break these terms or the law while using it, and someone makes a claim against us as a result, you agree to cover our reasonable costs of dealing with that claim, including reasonable legal fees. This doesn't apply to the extent the claim was caused by our own wrongdoing.
13. Governing law and where disputes are heard
These terms, and any dispute about the site or these terms, are governed by the laws of the State of New Mexico, USA, and applicable US federal law, without regard to conflict-of-law rules. Any such dispute will be heard only in the state courts located in New Mexico or in the United States District Court for the District of New Mexico, and you and we both agree to the jurisdiction of those courts.
Before going to court, please contact us first. Most problems can be sorted out with an email.
14. Changes to the site and to these terms
We may change, suspend or remove any part of the site at any time.
We may update these terms from time to time. When we do, we'll post the new version on this page and change the effective date at the top. Changes apply from that date and don't apply retroactively to anything that happened before it. If you keep using the site after a change, you accept the updated terms.
We may transfer the site and these terms to a successor, such as a company formed to run the Test Junkie project. If that happens, the successor takes our place under these terms and we'll update section 1.
15. Contact
- General questions, bugs and feature requests: GitHub issues
- Legal notices, copyright or trademark concerns, and private security reports: hello [at] test-junkie [dot] com
If you believe content on the site infringes your copyright, email us with the work you believe is infringed, the page where it appears, your contact details, and a statement that you believe in good faith the use isn't authorized. We'll review it and remove or correct material where appropriate.
16. General
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a part of these terms right away, we haven't given up the right to enforce it later. These terms, together with the Privacy Policy and the licenses referred to in section 3, are the whole agreement between you and us about the site.
